If you are completing a survey or accessing the platform because your employer or another organisation has engaged us, you are a permitted user. The service is provided to you through that organisation's Project Services Agreement with us, not as a consumer product.

If you are the organisation that pays for our services, the commercial terms (fees, payment, refunds, deliverables) are governed by your Project Services Agreement with us, not these Terms.

Elite Rated provides a comprehensive team survey platform that enables organizations to:

• Create and distribute custom team surveys
• Collect and analyze team dynamics data
• Generate comprehensive reports and insights
• Track team performance over time
• Access actionable recommendations for improvement

You may access our Service in different ways: as a survey participant (via an invitation link from your employer), as an organisation admin (with login credentials), or as a visitor browsing this website.

When you access the platform, you agree to:

• Be at least 18 years old or have parental consent
• Provide accurate information where required
• Keep any login credentials or invitation links confidential
• Accept responsibility for activities under your access
• Notify us immediately of any unauthorised use

Survey participants typically access the service via a unique link; organisation admins use account credentials. You are responsible for maintaining the confidentiality of any credentials or links you receive.

You agree not to use this website or the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for commercial purposes without authorization

If you create or manage surveys

Organisations that use our platform to create and distribute surveys agree to:

• Ensure all content is accurate and appropriate
• Respect participant privacy and confidentiality
• Obtain necessary consents for data collection
• Comply with applicable data protection laws in their jurisdiction

If you complete surveys

When you complete a survey as a participant, you consent to your responses being processed for the purposes of the survey and reporting, as described in our Privacy Policy. Your employer or the organisation that invited you is responsible for ensuring lawful collection of your data.

Data Ownership

Survey content: Sometimes we provide the survey (e.g. standard question sets, frameworks) — we own the intellectual property in those materials. Sometimes the organisation creates or provides the survey content — they own that content, and we host and process it on their behalf.

Results: In all cases, we do not own the survey results, reports, or participant data. The organisation that commissions the survey owns those. We process this data solely to provide our services and in accordance with our Privacy Policy and any Data Processing Agreement in place.

Data Protection

We implement appropriate security measures to protect your data. Organisations using our platform are responsible for ensuring their use complies with applicable data protection laws.

If you are a survey participant or casual visitor: These payment terms do not apply to you. You do not have a direct payment relationship with us.

If you are an organisation that pays for our services: Fees, payment terms, and refunds are governed by your Project Services Agreement with us, not these Terms. That agreement sets out pricing, payment milestones, and any refund or cancellation terms.

Our Rights

We own the Service, platform, and any survey content we provide (e.g. standard question sets, frameworks). These are protected by copyright, trademark, and other intellectual property laws.

Organisation Rights

Organisations that provide their own survey content retain ownership of that content. Organisations always retain ownership of survey results, reports, and participant data — we never own those. You grant us a limited licence to process and store your data solely for the purpose of providing our services.

License

We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose, subject to these Terms.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Service, you consent to the collection and use of information as described in our Privacy Policy.

We strive to maintain high service availability but cannot guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or other operational reasons.

We will provide reasonable notice for scheduled maintenance and work to minimize service disruptions.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for any claims arising from these Terms or your use of this website or the Service shall not exceed: (a) if you are an organisation that has paid us for services, the amount you paid us in the 12 months preceding the claim; or (b) if you are a survey participant, casual visitor, or any user who has not paid us directly, the sum of £1.

You agree to defend, indemnify, and hold harmless Elite Rated from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through the Service

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. We will retain your data for a reasonable period as required by law or for legitimate business purposes.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
